This marketing planââ¬â¢s overall message is to communicate to consumers that Wal-Mart is becoming an industry leader in selling organic foods. This plan should show consumers that Wal-Mart is taking a step forward in their corporate social responsibility and still sticking to their main strategy of always providing the lowest prices. The first specific strategy for this marketing campaign is to have 100% of regular Wal-Mart customers to be aware that Wal-Mart has a new and improved organic section. This goal should be achieved within six months of the campaign being launched. This campaign is designed for every consumer to be aware that Wal-Mart is moving towards the growing business of selling organic foods. The consumer should also be given reasons why Wal-Mart is re-launching a brand new organic section. Employees who interact with consumers should always try to let the consumer know of Wal-Martââ¬â¢s new efforts to invest in foods that are produced through environmentally friendly practices. Answer: Prosecution on sentencing In this case, Leo, being a Protective Service Officer (PSO) has caused reckless injury to Sam and his friends at 1 am in the morning on July 20, 2016 while he was patrolling at Flinders Street station. Section 17 of the Crimes Act 1958 lays down that any person who causes seriously injuries to another person recklessly without having lawful justification or excuse for such act, the person is said to have committed an indictable offense[1]. Any person guilty of committing an indictable offense shall be punished with an imprisonment for a period of 15 years. According to section 18 of the Crime Acts 1958, any person who deliberately or recklessly causes injury to another person without any lawful excuse is said to be guilty of an indictable offense[2]. Any person who causes reckless injury to another person shall be punished with imprisonment for a period of 5 years and if such person has caused the injury to any person intentionally, such person shall be punished with imprisonment for a period of 10 years. An act of recklessness requires the accused person to foresee the likeliness of the injury that may occur to the victim as a consequence of his or her actions or conduct. In this context, the term injury shall include that hysteria, unconsciousness, pain, any substantial impairment of bodily function[3]. An indictable offense such as causing reckless injury to any person shall carry a maximum penalty of imprisonment for a period of 5 years and /or a fine amounting to 1200 penalty units. Indictable offences are serious offences by nature and persons accused of committing indictable offenses are tried before a judge and a jury in the County or the Supreme Court[4]. However, such offense may be heard summarily before the Magistrates Court provided the court deems fit and the defendant assents to the same. In this matter, the Leo, a newly recruited police service officer, caused reckless injury to Sam and his friends, as he was highly irritated from the comments passed by Sam and his friends on July 20, 2016. Sam and his friends were only yelling under the influence of alcohol. Leo being a police officer could have warned them for behaving in that manner; instead, he himself got engaged in a brawl with Sam and his friends. It is expected from a protection police officer that they would safeguard the country and ensure safety of its citizens. In this matter, the Protection Police Officer himself got involved in causing Sam and his friends injuries without having any lawful excuse for the same. Sam and his friends were yelling at the police officers including Leo as they were not in their senses and was under the influence of alcohol. As per the statutory definition of reckless injury laid down under, section 18 of the Crimes Act, 1958, any person who without any legal justification, causes injures to other knowing that his conduct shall cause injuries to such person, is said to have committed reckless injury. Such person is liable to be punished with imprisonment for a maximum period of 5 years[5]. Further, the court must consider the following sentencing factors that have been laid down under section 5 (2) of the Sentencing Act 1991: Present sentencing practices Nature and gravity of the offense Statutory maximum penalty Whether the offense is a hate crime Injury, damage or loss from the offence Impact of the offense on the personal circumstances of the victim (VISs) Aggravating or mitigating factors Early entry of a guilty plea As per section 5(1) of the Sentencing Act (Vic) 1991 sentences are purported to be imposed for the following reasons: Deterrence Rehabilitation Protection of the community Denunciation just punishment All of the above According to section 109 of the Sentencing Act 1991, in case a person has committed indictable offence and such offense has been tried summarily, the matter shall be heard before the Magistrate. The person committing such offense shall be punished with imprisonment for 5 years and shall be liable to pay maximum fine of 600 penalty units. Reports reveal that the people aging from 17 years to 81 years are usually sentenced for causing injury recklessly[6]. As per statistics, men that are sentenced for causing reckless injury are slightly more aged than women are that is, a median age of 30 years compared to 29 years. In this matter, Leo contended that he is proud of his new qualifications and the new ways to serve the community. Therefore, when Sam and his friends were insulting him and his position he pushed Sam forcefully, and even attacked vividly. Sam mentioned in his Victim Impact Statement that Leo was so aggressive that he is fearful of Protective Service Officer (PSO) and the police generally. He also mentioned that he suffered minor scratch towards his head when he was forcefully pushed to the ground. The general police officers including the Protective Police Officer are under statutory obligation to protect the country and its citizens. If the citizens are scared of the police officers or the Protective service Officers, then the citizens shall feel reluctant to complain about any wrongs or crimes, which would enable the criminals to commit more crimes in the country[7]. The police officers are recruited to safeguard the citizens and they are under statutory obligation to act in the best interest of the country and its citizens. If they exhibit aggressive conduct, it would have an adverse impact on the society and the country as a whole. According to the statutory provisions, it is apparent that Leo has committed reckless injury towards Sam and his friends and is liable to be punished with imprisonment for a maximum period of 5 years with a fine of 600 penal units[8]. Reflective Report As per the case study, I observed that Leo is the PSO for Victoria Police and new recruiter in the department. At time of his duty, Sam who was a hooligan tried to abuse him and his colleges tried to saying some misleading objects. When he became irritated, he could not able to control his anger, pushed Sam to the ground forcefully, and sprays capsicum spray to him. His collogues noticed that he forcefully hit him. The victim was not seriously injured, he have suffered minimum head injury. Now, Victoria Police suspended him for a month without pay, charged with sec-18 of the Crimes Act 1958[9], and sent him to the Magistrate for the plea. Now, as per my investigation when he commences the offence he was in duty. When Sam was abusing him, he could have arrested him and handed him over to the Victoria Police. However, in anger he beats him. As per his record, he has good reputation and his family was well known to their community. From the observation of a defendant, sec- 16 defines in the Crimes Act that a person can be define as an accused if he cause injured to another person intentionally and sec 17 defines, a person can be treated as an accused if he recklessly cause any injury to the victim. While sec 18 of Crimes act defines the causing injury without lawful excuse intentionally or recklessly, I believe in this matter, Leo had no intention to harm Sam intentionally. There is also no lawful excuse that could be established because if Sam did not abuse him in front of his friends, then he would not have hit him. When Sam abused him, he out of anger beats him. His past record showed how responsible he is towards his job. Here, Sam was also commenced offence against a PSO who is in duty[10]. As per the view of the prosecution, when Sam tried to abuse Leo, the PSO can complain against the victim but he does not need to beat him that much when the PSO is not the actual cop. However, there is no lawful excuse established in this case and he did not intentionally harm Sam so, as per my belief, he is innocent and did not cause serious injury to Sam. Sam was slightly injured. Therefore, the Magistrate court must not imprison Leo according to sec- 109, Sentencing Act, 1991[11]. As per this section, for this offence a person can be imprisoned for at least 5 years or fine $600 penal units. However, as per my opinion, the court may again investigate the whole issue. Leo was not intending to cause any injury to Sam[12]. He is already guilty for beating Sam and the Victoria Police suspended him for 1 month without pay. The court can again review the whole case, punish him with the penalty of minimum fine, and acquit him. Sam must be punished as because he abused Leo when he is on duty of patrolling. They have to mentally prepare and determine whether or not they are ready to face a tougher challenge. In this case point, English 105 is the next level. English 105 involves Argumentative writing and critical analysis of basic human issues. In other words, it is a college composition class. Every English class I have taken, I have always known what was expected in that class. English 105 without a doubt is a tough class, but I am willing and ready to take that challenge. During highschool, I have always been interested in taking English courses. Throughout those classes, I have taken in information that has developed me into an intelligent human being. My communication skills are good. People can clearly understand what I'm talking about. I've always received a higher than average grade point in English. The most important tool I have used for something new is to expect the unexpected. Always expect harder and be ready for surprises. Those words have gotten me far in life and I believe they prove effective. There were plenty of times when I received surprise quizzes and even tests. Many people wouldn't have been ready because they were never told about these events. I on the other hand, don't trust the schedules that are handed out to me. I take the time and read and study. Music in Japan offers a vibrant preface to the music of modern Japan, a nation in which traditional, western, and popular music thrive side by side. Wade focuses on the major periods of the development of modern music in Japan throughout the book and in the musical selections on the accompanying CD. When considering the interface of Japanese music with other Asian cultural spheres, many traditions remained intact during the transitional periods. Wade explains how the musical cultures of China and Korea have influenced Japan since ancient times. This is most prevalent in rites, rituals and ceremonies in Japan. The traditional music of Japan calls for instruments of their native land. The book includes many illustrations of instruments, dances and costumes used for these traditional events. Wade then shows how Japan's thriving popular music industry is also a modern form of a historically important facet of Japanese m usical culture: the process of gradual popularization, in which a local or a group's music eventually becomes accessible to a broader range of people. Being initially trained in western classical music, Japanese artist began to form ensembles that utilized the standard orchestral format. Eventually composers emerged releasing their original compositions for orchestra. Beyond original classical composition, palace and temple music gained a new depth. Ensembles using traditional Japanese instruments that were commonly utilized in the palace and temple developed a new sound. Albert Jacka Soldier Man
Albert Jacka was born on the 10th of January 1893 in a small dairy farm in Winchelsea, Victoria. On the 17th of the first 1932, seven days after his 39th birthday, he died of chronic nephritis. He was the fourth child of 7 of Nathaniel Jacka and Mary Elizabeth Kettle. He spent most of his life in Wedderburn after his parents decided to move the family there in 1898 when Bertie was the age of 5. After completing elementary school, he found work as a labourer with his father, and later for the Victorian State Forests Department. On 18/8/14, Bert enlisted into the Aussie Imperial Force, assigned 14 Battalion, 4th Brigade, 1st Division and began training at Broadmeadow camp. Jackas battalion then left for further two months of training in Egypt. After that, his battalion then joined the fight in Gallipoli, arriving on Anzac Cove through the Dardanelles, 26/4/15. A month later on the 19th, the Turkish began an assault along almost the whole Anzac line, and captured a small twelve yard section of the trench, leaving one end being guarded by Jacka. For longer than several minutes, he shot warning shots into he trench until, finally reinforcements had arrived. Everybody but Jacka were hit so he leapt back into the communication trench. He had then thought up a new plan, two bombs would be thrown at the Turks, as Bert would walk around and flank them from behind. He shot five and bayoneted two as the others retreated. l managed to get the begars, Sir, he was quoted to have said to the first officer to arrive. For doing this act of courage, he was awarded with a Victorian Cross, which appeared in a section of the London Gazette. War Office, 24th July, 191 5 His Majesty the KING has been graciously pleased to award the Victoria Cross to the undermentioned Officers and Non-commissioned Officers:No. 65 Lance-corporal Albert Jacka, 14th Battalion, Australian Imperial Forces. For most conspicuous bravery on the night of the 19th-20th May, 191 5 at Courtneys Post, Gallipoli Peninsula. Lance-corporal Jacka, while holding a portion of our trench with four other men, was heavily attacked. When all except himself were killed or wounded, the trench was rushed and occupied by seven Turks. Lance-corporal Jacka at once most gallantly ttacked them single-handed, and killed the whole party, five by rifle fire and two with the bayonet. Albert was immediately known as a national hero. He began to be used on recruiting posters John Wren, gave him E500 and a golden watch, after promising the first Victorian Cross winner a reward of so. After the 28th of 8th he began to skyrocket from rank to rank, beginning with Corporal, then on the 12/9, Sergeant, then Company Sergeant Major on 14/11, and finally Second Lieutenant on the 29/4/16 after completing officer training. Early in June, the 14th Battalion were then sent to France. On the 7th of August, Berts platoon then moved into the line close to Pozià ©res, a small French village. One night after dawn, Just as Jacka had completed his surveying of the area, two German soldiers had overrun a part of line. They came to the entrance of Jackas dugout, rolling a bomb down the doorway, killing two men. Jacka survived, rushing up the steps, tiring as ne moved. He got up and came upon German soldiers rounding up about forty Aussies as prisoners. He spoke out to his platoon and charged against the enemy. Men threw away their rifles and began to participate n wild hand to hand combat, while the prisoners turned on their enslavers. On that night, they took capture of fifty Germans and retook back the line. Everyone was severely wounded, Jacka received serious neck and shoulder injures and was sent away to London hospital. On the 8th of the 8th, London newspapers sent out false reports claiming that Bert was killed in action. After this, Albert was promoted to captain and was authorised as the 14 Battalions Intelligence officer on the 15th March. Albert got back into the fght and led a night scouting party on the 8th of April, to inspect the enemys defences. He infiltrated the wire at two places, reported back, then he went out again to watch the laying of the guide tapes for the infantry. As the Job was almost done, two German soldiers creeped up, Jacka, realising that theyd see the tapes, he knew that they must be captured. He pulled out his pistol, misfired, so he rushed on towards them and captured them by hand. His smart, quick thinking, had saved the Anzac soldiers from discovery and possibly bombardment and had earnt himself a bar to his military cross. The newly captained Jacka, on the 8th July, was wounded by a snipers bullet near Ploegsteert Wood. Two months later on the 26th, he was back on his feet and back on the front, he led the 14th battalion against German Pillboxes(small underground outposts) at Polygon Wood. In March 1918, Jacka unknowingly faced his final fght, after being cruelly gassed at Villers-Bretonneux. A few months later, he boarded the Euripides, for Australia. A large crowd, including the Governor General, greeted him on his arrival in Melbourne. A few months after being discharged, R. O. Roxburgh, E. J. L. Edmonds and himself, created an electrical goods importing and exporting business. The following year on the 17th January, Jacka was hitched to Frances Veronica Carey, a typist at his Electrical Goods business. A few moths later, the moved to St Kilda and adopted a daughter. Eight years later, he was elected to the St Kilda Council and a year later elected as mayor. On the 18th of December 1931, he mysteriously fell ill during a council meeting and on January 17th, a year later, he died of chronic nephritis. Over 60,000 people paraded by his coffin as it lay in Anzac house. He was buried with complete military honor in the Presbyterian section of the cemetery.

Risk management in British Airways - Essay Example The overall process has been designed in a manner that it remains an iterative process wherein the changes and implementation of the existing and new risk management practices are scrutinized on continuous basis.( Goh, 2011). British Airways (BA) has a separate Corporate Risk Management Group in place which not only oversees the organization wide risk management practices of the firm but is also involved in managing internal control systems of the company. The Corporate Risk Group is overseen by a management board and senior key executives to ensure that the involvement of the key senior managers remains so that required improvements could be achieved and the process is managed strategically. The existing risk management practices of BA involve not only the identification of the key risks and their drivers but also their mitigation and management. The overall process is monitored at the Board Audit Committee level and involves senior management to provide an independent review and in sight into the risk management practices of the firm. Current Risk Management Process The current risk management process and its infrastructure within the organization are based on a combination of independence and authority. BA has put in place a separate risk management group which has the overall responsibility of managing the corporate risk affairs of the firm. The group is headed by the Head of Corporate Risk and Internal Controls and oversees different aspects of the risk management process. Further, there is a supervisory management board which comprises of the key senior managers of the firm to provide strategic insight and ownership to the strategic management process within the organization. (Rothwell, 2011). Company maintains a corporate risk register which is actually used for the purpose of identifying the risks and recording them for the purpose of review and assessment. The overall assessment process is based on quarterly reviews wherein the management board as well as the senior managers along with the Corporate Risk Managers evaluate the existing and new risks and determine the future course of action. It is also important to note that this is the highest level within the organization which actually assess and outlines the risk management processes within the organization. The work is further distributed to the individual departments and risk leaders within each department responsible for the management of risk at the departmental and individual level. It is also important to note that the risk at the individual level is measured through an internally developed matrix called Heat Map. Heat Map takes into account each individual risk based on its likely impact and the overall likely scale.1 This therefore allows BA to map its overall risk identification process according to the overall importance and impact of the risk on the organization. Once the different critical risks are identified, mitigating factors for managing the risk are identified and are each risk is individually managed. A report is finally produced which attempt to address different risk issues and responsibilities and accountabilities are than fixed at the individual level to ensure that the overall process is delegated to the lowest level of the organization. Customers expect innovative products from Apple. Customers know that the company is providing with fancy and expensive products and are lost in the charm of owning such products. Customers expect that every marketing campaign will focus on a new product because rate of innovation at Apple is high. Failing to do so can tarnish the image of the brand. The third marketing related problem faced by Apple is its undefined target market. As mentioned before, Apple first innovates and then focuses on the target market for its products. In order to so it use s its marketing practices. An inefficient marketing campaign results in a failure and creates a huge problem for the company. Marketing is not a cheap game. It requires lot of resources. Its ads need to target the desired market segment. Marketing practices at Apple are not just related to ads and online advertising. It also includes opening up of retail stores in different parts of the world. Managing this practice is in itself a problem. Apple is critical of its marketing practice because it is afraid that what if the marketed product does not meet the customersââ¬â¢ expectations.
